China fair use[edit]

I am unsure I can give you a satisfactory answer as I am unable to parse all of your text. I can tell you, however, that when we speak of "fair use" we are dealing with copyright law which is widely different from country to country. The only copyright law that is relevant to content copyrighted in the United States is United States copyright law. I agree that "Whatever we publish must be legal according to US law". But I don't know why it is illegal to publish this tag, and the related pictures on Wilipedia according to US law.　If it is not illegal, it should not be deleted. Dongwenliang 23:23, 10 April 2007 (UTC).

If using an unlicensed image on Wikipedia is legal under both China- and U.S.-fair use, then I would think it would be less redundant to simply use {{Non-free fair use in}} or a more specific template. Hi again. I'm sorry to inform you Wikipedia has gotten much tougher on fair use images since last we spoke. They are now of the opinion that if somebody could take a free picture of the object, it's not fair use. I did manage to find a free picture of the a Jiahu flute, as well as a free sample of Jiahu writing. Since the archaeological site in the picture is still present, anybody could take a free picture of it. Let me know if there's anything I can do for you. -Nard 01:27, 26 July 2007 (UTC)[reply]

Thanks! Did Wiki get sued for using some unfree pictures? As you know every picture originally must be taken by someone at sometime, not formed by nature. So virtually there are no fair use pictures at all.... :( thanks for the always support. By the way who are "they"? I think we should change "they" to "we" by voting our own admins. No they didn't get sued, they have a much tougher policy on "fair use" than the law allows. ie just because it's fair use doesn't make it ok to use on Wikipedia. If you want you can read WP:NFCC and read up on the policy on "non-free media" as they call it now. Opposing the changes isn't going to help much, the ideal is to try to find free pictures and work with the system the best you can. "They" being the admins and the people who interpret policy (I hope someday to be an admin but my most recent request last week did not go well (Wikipedia:Requests for adminship/N). -Nard 02:12, 26 July 2007 (UTC)[reply]

So, your main objections seem to be that since it a picture of a dead Chinese soldier who's face is visible, you (and all Chinese) object. But, if it was somebody from a different culture you apparently would not object. There is only one solution. Find another picture, upload it to the Commons (and make sure it's either not copyrighted or is otherwise free to use), then post a message on the talk page with a link to the new picture and ask if there would be consensus to replace the existing picture with the new picture. Korean War image[edit]

I understand that you find the image offensive. That in and of itself, is not enough to justify censoring the image. In my opinion, nothing is enough to justify censorship. I abhor censorship in all forms, whether it is a method of control by an oppressive government, or if it's because someone finds something offensive. If you don't want to see something, don't look at it. We all have free will, and most of us are adults. I understand that you are offended (and any other Chinese as well) but we can't edit everything because a certain group doesn't like it. Say, for example, biased editors turn the article Liancourt Rocks so that Koreans don't like it. Simply because we don't like it doesn't mean that the article can be changed so that we like it.

Regarding the Korean War photo[edit]

As a fellow Chinese, I urge you to reconsider your judgement of the image of the dead Chinese soldier of the Korean War. Personally, I do not feel that the image is offensive or "insulting" to the Chinese people in any way, as you describe. Indeed, when I first sighted the photo, I assumed it to be some sort of image from the propaganda which our government has so often relied on, or perhaps from a book authored by a Chinese, much like the photos depicted in The Rape of Nanking. If a Chinese herself would bring herself to put such gruesome photos in her book, I do not see why Wikipedia should not.

What concerns me even more, however, is your discussion with a few fellow Wikipedians on the inclusion of the image. A Chinese myself, I could say that I understand your sentiments at times when interacting with Western counterparts; however, quoting the words both of our ancestors and of Wikipedia, one should assume good faith in all circumstances. The Chinese people's inclusion among the world's people will not be certified by military or economic power, but by a noble culture. Aran|heru|nar 15:26, 2 November 2007 (UTC)[reply]

Go head with the deletion. All the bronze pictues I uploaded got the approvals from the owner and I have attached the email from the owner too, if anyone can read the history of the images page or the files. From time to time, I got deletion tags and I have explain again and again and again how and from whom I got these pictures. The type of the tags had been changed at least 3 times too. Despite that, finally, they were all deleted now. Happy? you won? So, the only thing I try to say is that, you can delete the pictures, but you can not detroy the real 4,000 years fine bronze piece in China, and they are still there. Please read all the deletion notifications above and continue to abuse wikipedia's deletion friendly policies, continue to distort wikipedia and continue to turn wikipdedia into a coldwar machine! Some Insight from an American (GASP!)[edit]

I know my presence here is unsolicited, but I felt it might be pertinent to this topic to inject my feelings on this matter, so *exhales*... here goes.

I'm an American citizen, but let it be said that anyone who discounts me for my nationality is a fool.

I'm born of Christian ancestry, in what was founded as a Christian nation.

I, myself, am largely agnostic, and you may credit that to a state with far too much interest in imposing societal norms onto future generations.

It is truly a terrifying thing for me to look on - in silent, wide-eyed horror - as someone suggests we return to a time where little progress was achieved.

Before you condemn the ideas of "free speech" of another nation, you might consider what imposing your own ideas onto others will cause - the result is never good.

Unfortunately, we have a double-standard of sorts that must be dealt with according to our own domestic policy: the servers are located on U.S. soil, ergo they are subject to U.S. - and only U.S. - jurisdiction. Every time you protest an image on the grounds of being "offensive", of course that "logic" will not prevail where the image is not intentionally unproductive; as Chinese laws do not apply here (would you enjoy having U.S. copyrights enforced worldwide? No? Then you see the sacrifice), the site hosting this material is under no obligation whatsoever to keep "unacceptable" images from the very people they might offend.

It's important that you understand that there are people out there who need to know that such tragedies are taking place; would you seriously relegate them to snippets of reports from Xinhua that "nothing happened" or "you don't need to see what happened here"? Perhaps you are familiar with 天安門廣場? What's "pornography" for you qualified as such for us nearly two centuries ago - before we saw the value in having current imagery to illustrate a particular problem. Please do not misunderstand my intent; I do not mean to cause offense to you or your history. My point is simply thus: what you see as "taboo" is, to many other people - Chinese included - a vital part of the information exchange process.

Defending the denial of such blatantly pseudo-religious content-censoring dogma as being "racist" is not a new thing for me to see, but it IS the kind of depressing and destructive comment I can't stand reading, particularly given my own country's history with REAL racism.
